I have been trying to get Lunar Pages to resolve this issue for over a week. Crickets...........

You may want to submit a ticket to Miva. As far as getting your money back....not sure what your agreement is with Lunar. You may just need to cut and run. I would first get in touch with some of the other hosts that are on this site, get your domain and site set up and then tell Lunar to cram it. Most hosts will move your site for free.
You may lose a couple hundred bucks...but if your site is up and running and you are making money off of it, a couple hundred can be made back in no time. If your site is down then I would expect a response within 12 hours and a fix within 1 day. If your site is still running, I would give a little more lead time but still would expect a response within 1 day and a repair within 3.
Just my opinion is all....

This looks like your getting this during the streaming update going from PR7 to PR8. Is that correct? This means the store is not down? Result is you simply can't upgrade due to a configuration issue probably.
I've personally not heard of this host. If they aren't responding to tickets while using their support system, you may need to consider moving to another host.

Unable to download list of available patches usually occurs when the software is unable to communicate with us. The update is trying to compare what is installed to what is available to download and is unable to. I would suggest uploading our diagnostic tool to the web root to test communication with our license manager (example http://yourdomain.com/diag6.mvc). In most cases this communication issue can be caused by an out dated engine or OpenSSL is not available.

You'll need to request an engine upgrade if the diagnostic tool above shows v5.06 is running for your site. Below is a link to our website where your hosting provider can download the latest engine v5.13.

Setup of v5.12 of Empresa defaults the “certs” path to C:\Program Files\Miva Merchant\Miva Merchant Empresa\CERTS\openssl-1.0. If the server is running v0.9.x for OpenSSL, they need to change the path to C:\Program Files\Miva Merchant\Miva Merchant Empresa\CERTS\openssl-0.9.
V5.12 release notes “On Windows systems, the installer sets the default "certs" path to point to the OpenSSL 1.0 compatible directory. We strongly recommend that all Windows users upgrade to OpenSSL 1.0”.

I had a client that had this problem as well. It began when the host changed hands and the new host discontinued support for Miva Merchant, which included no more updates coming through. The client moved to a Miva supported host and hasn't had one problem since. So, that is my advice to you as well....change hosts. It is well worth it, since you'll only continue having headaches with your current host.
