Thanks for you response. I do not think I would ever take legal action as it is not worth the time. You just need to bill in a timely fashion. I like your idea about retaining copyright control, but then we are back to legalities.
So there is a $50 to move from my development site to there domain on Miva's server. This seem like the best solution. Then as you stated there is the issue of third part modules working on a different domain. That should be able to be worked out.
