No person or entity has any right, title or interest in or to any Intellectual Property Rights owned or licensed by Miva. Any use of Intellectual Property Rights owned or licensed by Miva, for any reason whatsoever, other than as permitted by Miva's Software Services, License and Hosting Agreement or other applicable written agreements or policies, may constitute infringement of Intellectual Property Rights. For avoidance of doubt, “Intellectual Property Rights” shall mean and include any and all original works of authorship, copyrights, trade secrets, trademarks, rights of publicity, inventions, discoveries, developments, patents, and any other form of intellectual property right or foreign counterpart thereof. You acknowledge and agree that any and all of Miva's products or services, updates thereto, content supplied by Miva, user interfaces, page layouts, page headers, scripts, or any portions thereof, or other copyright protected subject matter provided to you by Miva, including any and all marketing materials, is protected by copyright and/or other Intellectual Property Rights owned by Miva. No person or entity may copy, modify, rent, lease, loan, license, sell, distribute, create derivative works, decompile, reverse engineer, disassemble, attempt to derive the source code of, modify, or create derivative works thereof, nor attempt to disable or circumvent any security or other technological measure designed to protect Miva's products or services, without Miva's express written authorization.
Trademarks
Miva, Inc. (“Miva”) takes its intellectual property rights very seriously.
A trademark or service mark can be any word, phrase, symbol, designs, and/or combinations thereof that identifies and distinguishes the source of the goods and/or services of one party from those of others. The term “trademark” is often used in a general sense to refer to trademarks, service marks, trade names, brand names, slogans, logos, symbols, designs, phrases, trade dress (e.g. product appearance, product packaging, website layout, including the associated appearance, size, shape, color, or graphics, etc.), or other business, product, or service identifiers.

Use of the Trademarks is strictly reserved for Miva and its licensees. Miva's Trademarks may not be used in connection with any product or service that is not expressly authorized by Miva in writing, or in any manner which is likely to cause consumer confusion, mislead or deceive the public, or in any way disparage, tarnish, or discredit Miva's goodwill and reputation, including the use, adoption, or registration of any trademark that is likely to be confused with any of Miva's Trademarks. Unauthorized use of Miva's Trademarks is prohibited.
Trademarks and service marks not owned by Miva may also appear on this website, and such uses are at the authorization of their respective owners.
