Copyright Infringement Policy

Miva respects the intellectual property rights of others, and we ask the same of our customers. It is our policy to promptly investigate notices of alleged copyright infringement regarding materials hosted on our system or network and, where appropriate, to remove or disable access to the materials in question.

How to Submit a DMCA Notice

If you believe that a website that we host is infringing on your copyrights, please send us a written notice by email or mail to our Designated Copyright Agent:

We will respond only to notices that substantially comply with the requirements of the Digital Millennium Copyright Act (DMCA). To help ensure timely processing, please include all of the following in your notice:

  1. Your physical or electronic signature.
  2. Identification of the copyrighted work(s) you claim are being infringed.
  3. Identification of the material(s) on our customer's website that you claim are infringing, with information reasonably sufficient for us to locate the material (e.g., full URL(s)).
  4. Your contact information: full name, address, telephone number, and email address.
  5. A statement that you have a good-faith belief the disputed use is not authorized by the copyright owner, its agent, or the law.
  6. A statement, under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorized to act on the copyright owner's behalf.

Important Notice: Under the DMCA, any person who knowingly and materially misrepresents that material or activity is infringing may be liable for damages, including costs and attorneys' fees, incurred by the alleged infringer, a copyright owner or licensee, or by Miva, Inc.

What Happens After We Receive Your Notice

When we receive a compliant DMCA notice, we may remove or disable access to the material or website in question, and we will provide the website's owner with a complete copy of your notice. If the website owner files a counter notification, you will be notified and provided between 10 and 14 business days to file a lawsuit in district court to restrain the alleged infringement. If you do not notify us within that timeframe that an action has been filed, we may restore the material to our customer's website.
